MIAMI, Fl. – Is weed legal in Florida, particularly for recreational use? Although recreational marijuana has not been legalized in Florida, a Florida Office of Economic and Demographic Research report claimed that if recreational marijuana use were approved, the Florida economy would be boosted with millions of dollars in sales tax and tourism annually. There were many attempts to legalize the use of recreational marijuana, but one major challenge has been the lack of proper organization. 

What Is Prohibited and What Is Permitted?

Marijuana is only lawful in Florida if a person has gotten a Medical Marijuana Use Authorization, as detailed in Chapter 381 of the Florida Statutes. This law includes provisions for a user registry, caregiver possession, and treatment centers where people can buy edible marijuana in Florida.

Given that, possessing 20 grams or less is a misdemeanor offense punishable by up to a year in jail and a $1,000 fine. Possession of more than 20 grams is a felony punishable by up to five years in prison and a $5,000 fine.

When Will Recreational Weed Be Legal in Florida?

According to Florida law, for a proposed initiative to be considered by the Florida Supreme Court, it must receive roughly 223,000 voter signatures. At that point, the court assesses whether a measure complies with the single-topic rule, ensuring that it is focused on one issue and meets standards of clarity and integrity. 

When will Florida legalize recreational weed? The state Supreme Court of Florida has opposed and rejected prior attempts to legalize adult usage, putting the issue on the ballot. The Smart & Safe Florida political committee claims such an opposition won’t occur because of improved wording in their proposed amendment to the state’s marijuana statute.
